The Public Spaces New York Got by Letting Developers Build Bigger
New York's privately owned public spaces were born from a zoning bargain: developers got extra floor area, and the city got plazas, arcades, atriums, and a lot of uneven results.
New York has public spaces that do not quite feel public.
You may have walked through one without realizing it: a plaza in front of an office tower, an indoor atrium with a security desk nearby, a pocket of chairs beside a corporate lobby, a terrace that looks private until a small sign says otherwise.
These places are called privately owned public spaces, or POPS. The name sounds contradictory because the bargain is contradictory.
The land is private. The access is public. The reason they exist is zoning.
Where to start
Try the public space at 180 Maiden Lane, the Elevated Acre at 55 Water Street, or the plaza at 590 Madison Avenue in Manhattan. Each shows a different version of the POPS bargain.
To understand why New York made this deal, you have to go back to the problem of height.
In the early skyscraper era, buildings could rise straight up from the sidewalk and fill their lots with massive walls of offices. The 1916 Zoning Resolution responded by requiring setbacks. As buildings got taller, they had to step back from the street, producing the famous wedding-cake shape of many prewar towers. The idea was to preserve light and air at street level.
Setbacks worked visually, but they were blunt. They shaped buildings by forcing them to surrender volume as they rose.
In 1961, New York replaced that system with a new zoning framework built around floor area ratio, or FAR. The concept is simple: multiply the lot area by the allowed FAR, and you get the maximum amount of floor area that can be built on the site. A developer could distribute that floor area in different ways, which gave architects more flexibility than the old setback rule.
Then the city added an incentive.
If a developer provided publicly accessible open space, the zoning code could allow extra buildable floor area. In many districts, one square foot of qualifying public plaza could generate multiple square feet of additional building. The classic figure was a six-to-one bonus: one square foot of public space for six square feet of extra floor area.
The model had an icon: the Seagram Building.
Completed in 1958 on Park Avenue, Seagram did something unusual for a high-value Midtown site. It pulled back from the street and created a broad plaza in front of the tower. The building gave up ground-level real estate, but the result was powerful: a clear view of the tower, a dignified forecourt, and a new image of corporate modernism. Planning studies leading to the 1961 zoning overhaul treated Seagram as proof that New York could trade building bulk for open space.
The city wanted more of that.
What it often got was less.
The Municipal Art Society's APOPS project is blunt about the original flaw: the 1961 rules offered valuable floor-area bonuses without strong design and operating standards. Early plazas and arcades were not always required to provide the things that make people actually use public space: comfortable seating, good sunlight, landscaping, clear signs, inviting edges, or reasons to linger.
So developers did what the rule rewarded. They created space, collected the bonus, and sometimes left behind windswept pavement.
That is the central tension of POPS. On paper, the city gained an extraordinary network of public access on private land. In practice, some spaces became beloved urban rooms, while others became technical compliance: open but empty, legal but unwelcoming, public only if you already knew your rights.
Over time, the city tightened the rules.
The 1970s brought more attention to plaza design, helped by observers like William H. Whyte, who studied how people actually use small urban spaces. The lesson was practical: people sit where there are places to sit. They stay where the microclimate is pleasant. They gather where food, shade, edges, and movement make a space feel alive.
In 2007, New York adopted another major update to POPS standards. The newer rules addressed seating, tables, trees, planting, lighting, visibility, circulation, signage, and operations. Later standards continued to refine what a public plaza should provide. The city was correcting the first generation's mistake: public access is not enough if the design tells people to leave.
That makes POPS one of New York's most revealing urban inventions.
They show the city using private development to buy public benefit. They also show how hard it is to write generosity into a zoning code. A plaza can be technically open and still feel hostile. A sign can say "public" while the architecture says "keep moving." A beautiful space can be privately controlled in ways a park is not.
The best POPS are genuinely useful. The Elevated Acre at 55 Water Street feels like a secret park lifted above the Financial District. 590 Madison Avenue offers a well-known Midtown indoor public space beside one of the city's most corporate corridors. Other spaces provide lunch spots, shortcuts, shade, restrooms, or small moments of relief in neighborhoods where land is too expensive for many new public parks.
The worst ones remind you that a loophole is not the same thing as civic design.
That is why the little POPS signs matter. They are not just labels. They are evidence of a contract: the developer received something valuable, and the public is owed something in return.
New York's privately owned public spaces are not parks in the ordinary sense. They are zoning receipts scattered through the city.
Some are beautiful. Some are barely useful. All of them reveal the same bargain: extra building above, public space below.
